Aged 47 S underwent routine laparoscopic cholecystectomy.

The operation was converted to an open procedure as the bile ducts were divided inadvertently.

S required treatment in the high dependency unit, she suffered repeat colitis (inflammation) of the bile ducts leading to high temperature, shakes, and lethargy.

S developed an incisional hernia and suffered from extensive scarring.

It was S's case that her injury occurred due to substandard operative technique.

CAUSATION

It was S's case that had her operation been performed correctly she would have made a full prompt recovery.

OUTCOME

The hospital admitted that the injury occurred due to substandard care.

Compensation was agreed at £125,000 without trial.
