Aged 43 W underwent private laparoscopic cholecystectomy.

During the procedure her common bile duct was severed. W was transferred for repair of the bile duct.

W suffered from episodes of infection and fatigue due to cholangitis. It was thought W's symptoms would resolve within 12 months.

BREACH OF DUTY

The surgeon accepted that it was negligent to damage the common bile duct
