W v Medway NHS Trust (2007)

Aged 53 W underwent removal of his gall bladder by laparoscopic surgery during which his gall bladder was severed.

W required reconstructive surgery (Roux en Y hepatico jejunostomy), suffered from repeat infections, abdominal distension, and hernia.

W had a significant risk of developing further strictures and it was likely he would require a liver transplant in future.

BREACH OF DUTY

The hospital accepted that the standard of surgery was unacceptable.

OUTCOME

Compensation was agreed at £290,000
