FACTS

Aged 27 G's cervical smear contained abnormal cells.

The smear was reported as normal.

Aged 30 G was referred for colposcopy by her GP following spotting between periods and erosion of the cervix.

The colposcopist identified concerns with G's cervix however arranged a six month follow up appointment rather than 14 day appointment.

Aged 31 at her follow up appointment (6 months later) G was diagnosed as suffering from cervical cancer.

G required removal of her cervix, radiotherapy and chemotherapy rendering her infertile.

BREACH OF DUTY

It was G's case accepted by the Defendants that her smear at age 27 was misreported and she should have come to colposcopy at that time.

It was G's case that booking a six month follow up appointment rather than 14 days as intended was unacceptable.

CAUSATION

It was G's case that treatment when she was aged 27 would have been limited to loop excision.

Her loss of fertility, loss of cervix, and requirement for chemotherapy and radiotherapy would have been avoided.

OUTCOME

Liability was accepted and settlement agreed at £120,000 without trial.
