Bladder damage during hysterectomy

X v Sandwell and West Birmingham NHS Trust (2004)

Aged 43 Mrs X underwent vaginal hysterectomy during which her bladder was damaged leading to leakage.

The damage was identified at the end of the procedure and the surgeon attempted a repair unsuccessfully.

Mrs X underwent re repair by a urological surgeon. Mrs X suffered from fistula and required further repair.

BREACH OF DUTY

It was Mrs X's case that her treatment was substandard in that the gynaecologist should have requested the assistance of a urological surgeon rather than seeking to repair the bladder damage, that her post surgical management was negligent preventing the damage from healing, and that there was a negligent delay in diagnosing and treating the ongoing fistula.

CAUSATION

Mrs X suffered from four years of incontinence and infection.

OUTCOME

Compensation was agreed at £45,000
