FACTS

In 2005 S had blood taken by a GP healthcare assistant. S developed compartment syndrome (lack of oxygen to muscle due to pressure on muscle compartment) and nerve damage.

Although S made a full physical recovery from his compartment syndrome and nerve damage he developed a depressive psychological reaction.


BREACH OF DUTY

It was S's case that the healthcare assistant failed to follow proper procedures in attempting to take blood from his vein leading to his artery being punctured by the needle.

CAUSATION

It was S's case that because of his arterial puncture he suffered loss of blood into his arm leading to significant bruising, development of compartment syndrome (caused by the bruising), and nerve damage again caused by the pressure on the nerve. 

OUTCOME

Although responsibility for S's injury was denied the claim was settled without trial with payment of £20,000.
