Delay in referral with symptoms of bowel cancer

H v Dr Verma (2006)

Aged 67 Mrs H presented to her GP with persistent diarrhoea, rectal bleeding, and anaemia. 

Subsequently Mrs H suffered perforated bowel associated with bowel tumour.

Mrs H was diagnosed with liver metastases.

BREACH OF DUTY

It was Mrs H's case that her GP should have referred her for investigation leading to diagnosis and treatment seven months earlier.

CAUSATION

It was Mrs H's case that she would have been spared seven months symptoms and her bowel perforation although her other treatment and prognosis would not have been altered.

OUTCOME

Compensation was agreed at £14,000 without admission of liability
