SIX MONTH DELAY IN DIAGNOSIS OF BREAST CANCER; MASTECTOMY CHEMOTHERAPY RADIOTHERAPY

£40,000 for delay in diagnosis of breast cancer. Earlier diagnosis would have avoided chemotherapy.
Aged 37 G attended her GP with a lump in her right breast. The GP diagnosed mastitis. The lump remained and G was referred to breast clinic a month later. A fine needle aspiration was carried out and follow up appointment arranged for six months.
G's lump continued to grow and she arranged for a private assessment. Mammogram was undertaken at the private assessment and follow up investigations led to a diagnosis of breast cancer.
G underwent mastectomy, chemotherapy, and radiotherapy.
BREACH OF DUTY
It was G's case that her breast cancer should have been diagnosed at or shortly after her first hospital appointment some six months earlier than eventual diagnosis.
CAUSATION
It was G's case that diagnosis and treatment six months earlier would have allowed treatment solely with lumpectomy. Mastectomy, chemotherapy, and radiotherapy would have been avoided.
OUTCOME
The case was disputed by the hospital and damages agreed without admission of liability at £40,000. This was on the basis that G would have avoided radiotherapy however required mastectomy and chemotherapy even had her tumour been diagnosed earlier.
