Delay in diagnosis of ovarian tumour, death

B v Dr Sharp, Christie Hospital NHS Trust (2004)

Aged 51 Mrs B was diagnosed with ovarian tumour.

In the three years before diagnosis Mrs B had been investigated for abnormal cervical smear results and undergone hysteroscopy to exclude ovarian tumour.

Following diagnosis of ovarian tumour Mrs B underwent hysterectomy and chemotherapy.

Mrs B died four years after diagnosis.

BREACH OF DUTY

It was Mrs B's case that proper investigation three years before diagnosis would have identified the ovarian tumour.

CAUSATION

It was Mrs B's case that treatment of her ovarian tumour three years earlier would have improved her prospects of survival and life expectancy.

OUTCOME

It was accepted by the gynaecologist that the tumour should have been diagnosed earlier however it was disputed that Mrs B's prognosis would have been improved.

Compensation was agreed at £120,000
