DISCECTOMY AND LAMINECTOMY ON INCORRECT VERTEBRAE

B V ST ALBANS NHS TRUST (2003)

£650,000 for surgery on incorrect intervertebral discs.

Mr B underwent what was intended to be discectomy at L4/L5 and subsequently laminectomy at L5. Mr B's back pain was exacerbated by the operations and he was left unable to work.

Expert evidence concluded that both the laminectomy and discectomy had been performed at the wrong levels.

The case was settled following mediation for £650,000 with £50,000 apportioned to pain and suffering, £484,000 for loss of earnings, with the balance for care, equipment, transport, and general help needed.
