Delay in diagnosis of ectopic pregnancy

L v Barking, Havering & Redbridge Hospitals NHS Trust (2007)

Aged 39 Mrs L presented to hospital with severe right sided abdominal pain. She was discharged with pain relief however no follow up was arranged.

11 days later Mrs L was referred by her GP with suspected ectopic pregnancy. Mrs L was admitted to hospital however discharged two days later without follow up.

Two days after discharge Mrs L was readmitted to hospital requiring laparotomy and salpingectomy during which she suffered uterine perforation.

BREACH OF DUTY

It was Mrs L's case that there was a negligent failure to diagnose and treat her ectopic pregnancy.

CAUSATION

It was Mrs L's case that prompt treatment would have avoided her uterine perforation, pain and suffering and adhesions. Mrs L accepted that she would have required removal of her fallopian tube even had her ectopic pregnancy been treated sooner.

OUTCOME

Liability was admitted and compensation agreed at £25,000
