P v Dr G (2008)

Aged 56 P attended his GP with pain in his mid and lower back. A blood sample was taken. The results were abnormal demonstrating abnormal ESR levels (the rate red blood cells fall through liquid).

The GP did not act on the abnormal blood result, P's symptoms deteriorated and four months later he was referred for investigation.

P was found to be suffering from spinal tuberculosis and meningioma (non metatastic tumour).

P became wheelchair bound, loss his bowel, bladder and sexual function, as well as suffering cognitive impairment and weakness of his arms.

BREACH OF DUTY

It was P's case that his GP was negligent in failing to refer urgently for investigation on receipt of the abnormal blood test results.

Liability was admitted.

CAUSATION

P would have suffered from some ongoing problems due to his meningioma however the severity of his problems would have been substantially reduced.

OUTCOME

Compensation was agreed at £2,750,000
