Mr B (deceased) v GP (2002)

£90,000 following GP's failure to diagnose heart disease.

FACTS

Aged 47 Mr B reported breathlessness together with chest and left arm pain to his GP. Mr B was known to have a family history of heart disease.

Later that same week Mr B twice reattended his GP reporting continuation of symptoms.

Mr B was referred by his GP for chest x ray however on the day of referral died from heart failure.

BREACH OF DUTY

It was argued on Mr B's behalf that his GP failed to properly examine him.

CAUSATION

It was argued that had the GP properly examined Mr B he would have sent him to hospital for urgent investigation, that Mr B's heart failure would have been diagnosed and his death avoided.

OUTCOME

Compensation was agreed at £90,000 without trial.
