Failure to remove cannula after use leading to infection

C v Oxford Radcliffe Hospitals NHS Trust (2007)

C developed infection at the site of a cannula, the infection was not immediately diagnosed and treated. As a result of the infection C suffered severe brain injury.

BREACH OF DUTY

It was C's case that her cannula should have been removed after use and to leave the cannula in situ was unacceptable. Also that there was an unacceptable delay in identifying and treating her infection.

CAUSATION

It was C's case that prompt removal of the cannula would have avoided her infection and that earlier diagnosis and treatment of infection would have avoided her injury.

OUTCOME

At trial judgment was given for C. The Court found that the cannula should have been removed and infection avoided and also that the infection should have been identified sooner which would have led to treatment avoiding the damage.
