HYSTERECTOMY, POST OPERATIVE HAEMORRHAGE, DEATH

CC v BUPA (2003)

FACTS

Following routine vaginal hysterectomy Mrs C was identified as suffering a severe fall in blood pressure (to 50/30).

After fluid replacement therapy blood pressure increased (to 100/60).

Blood pressure then fell (to 75/41) however no immediate further steps were taken.

Mrs C's condition deteriorated, she was transferred to ITU, where she died following a cardiac arrest.

Mrs C had suffered from massive blood loss due to undiagnosed internal bleeding.

BREACH OF DUTY

It was argued on Mrs B's behalf that following her second severe drop in blood pressure she should have been returned to theatre for investigation for haemorrhage.

CAUSATION

It was argued on Mrs B's behalf that had she been returned to theatre her haemorrhage would have been identified, repaired, and her death avoided.

OUTCOME

Liability was admitted and compensation agreed at £120,000
