B v Nuffield Hospitals (2008)
FACTS
Aged 68 Mrs B underwent knee replacement surgery.
The treating surgeon severed Mrs B's patella tendon and placed the components incorrectly.
Mrs B underwent revision of her knee replacement.
Mrs B did not regain full function of her knee. She required crutches to walk and experienced significant ongoing pain. It was possible Mrs B would require further surgery.
BREACH OF DUTY
The defendant accepted responsibility for their surgeon's failure to undertake the initial knee replacement properly.
CAUSATION
The independent surgeons for both Mrs B and the hospital agreed that proper surgery would have allowed her to return to near full function.
OUTCOME
Compensation was agreed at £322,000 of which £200,000 was assessed as allocated to provide care for Mrs B in future.
