DELAY IN DIAGNOSIS OF ORAL CANCER; FAILURE TO PROPERLY REPORT BIOPSY; DEATH

Mrs Manning was diagnosed with squamous cell carcinoma of the tongue and treated in 1994 with radiotherapy. She underwent biopsy of the tongue in 1995, 1996, and 2001. In 2001 she was diagnosed as suffering from recurrence of tumour. Mrs Manning died of her tumour in 2002.

The Judge found that evidence of recurrence of tumour was present in the 1995 biopsy and that the recurrence should have been diagnosed in 1995. The Judge went on to find that treatment in 1995 would have resulted in Mrs Manning's survival.

The hospital were liable to pay damages to Mrs Manning's estate and to her dependents.
