Perforation of uterus during dilatation and curettage (D&C)

B v Grimsby & Scunthorpe HA (1998)

During removal of retained products of conception following childbirth Mrs B's uterus was perforated in two places and her endometrium damaged.

B required laparotomy to repair the damage and suffered from intra uterine adhesions leading to repeat miscarriages and requirement for hysterectomy.

BREACH OF DUTY

It was Mrs B's case that her D&C procedure was negligently performed leading to perforation, endometrial damage, subsequent miscarriages and hysterectomy. 

OUTCOME

Compensation was awarded for pain suffering and loss of amenity including loss of fertility and scarring at £55,000
