SKIN CANCER, FAILURE TO REMOVE COMPLETE TUMOUR

£25,000 following recurrence of skin cancer leading to removal of right hand side of nose

J v Birmingham Heartlands Hospital and Solihull NHS Trust (2003)

FACTS

Aged 63 J had a basal cell carcinoma (rodent ulcer) removed from her nose.

Part of the tumour was missed.

The histology report identified that part of the tumour may not have been removed.

No steps were taken by the doctors to reexplore the area.

Aged 57 J was diagnosed with recurrence of tumour and required removal of the right hand side of her nose.

BREACH OF DUTY

It was J's case that on receiving the histology report the treating doctor should have reexplored her wound.

CAUSATION

It was J's case that reexploration would have led to removal of the retained tumour. The spread of tumour leading to the need to have the right hand side of her nose removed would have been avoided.

OUTCOME

Liability was admitted and compensation agreed at £25,000
