SPINAL FUSION; INCORRECT INTERPRETATION OF X RAYS; FOOT DROP

LEAKE V TARGETT (2005)

L underwent spinal fusion with the fixing of intervertebral cages. Post operative x rays showed that one of the cages had shifted however the x ray was interpreted as satisfactory. 

Five months after the operation movement of the cages was noted on repeat x ray and revision surgery undertaken.

L developed foot drop (the inability to raise his foot around the ankle).

BREACH OF DUTY

It was L's case that the defendant had negligently failed to realise that the cages had shifted on review of the post operative x rays.

CAUSATION

It was L's case that had the defendant realised the cage had shifted he would have undergone prompt revision surgery and his foot drop avoided.

OUTCOME

At trial the Judge found for the Claimant.
