FACTS

Aged 44 years in her first pregnancy Mrs V was managed by her GP surgery and by the hospital.

Mrs V's pregnancy was uneventful and she attended regular midwife appointments.

Mrs V presented to hospital at 42 weeks gestation with regular contractions.

No fetal heart could be identified, labour was induced and Mrs V delivered of her stillborn daughter.

On post mortem examination it was felt the baby had died about three days before delivery probably of failing placental function.

BREACH OF DUTY

It was Mrs V's case that due to her age her placental function should have been monitored regularly from 30 weeks gestation and that labour should have been induced at 40 weeks gestation.

CAUSATION

It was Mrs V's case that had her daughter been delivered four days earlier she would have been delivered without injury.

OUTCOME

8 months after first contacting Darbys compensation was agreed on Mrs V's behalf at £25,000
