Surgical equipment left in abdomen during hysterectomy

J v Medway NHS Trust (2007)

Aged 36 Mrs J underwent hysterectomy during which a piece of drain was left in the abdominal cavity (the drain had fractured on removal).

Mrs J required surgical procedure to remove the retained piece of drain

BREACH OF DUTY 

It was Mrs J's case that the technique used to remove the drain was substandard leading to fracture.

OUTCOME

The hospital accepted responsibility and compensation was agreed at £5,500
