Unnecessary hysterectomy and removal of ovaries, vascular damage

M v West Dorset General Hospitals NHS Trust (2004)

Aged 38 Mrs M underwent hysterectomy and removal of her ovaries for endometriosis. During the operation she suffered damage to her blood vessels leading to haemorrhage.

BREACH OF DUTY

It was Mrs M's case that she had not been appropriately investigated before being advised to undergo hysterectomy and removal of her ovaries. Also that the operation had been performed negligently leading to vascular damage.

CAUSATION

It was Mrs M's case that proper investigation would have demonstrated that her endometriosis was mild and hysterectomy not required.

OUTCOME

Mrs M's case was settled shortly before trial with compensation agreed at £55,000 taking into account the risk of the case being lost at trial.
