Ureter damage during hysterectomy

J V CHASE FARM HOSPITAL NHS TRUST (2003)

Aged 40 Mrs J underwent total abdominal hysterectomy and removal of her ovaries and fallopian tubes.

Three weeks after the operation Mrs J was diagnosed as having suffered damage to her left ureter.

Mrs J suffered ureterovaginal fistula, abdominal pain, repeat infection, and vaginal leakage. Mrs J required surgical repair and suffered from urinary incontinence and repeat infection.

BREACH OF DUTY

It was Mrs J's case that the surgeon had been negligent to damage her ureter and negligent to fail to recognise the damage at the time of her hysterectomy.

OUTCOME

Liability was disputed and compensation agreed at £40,000
