Delay in diagnosis of intrauterine infection following stillbirth leading to maternal death

C v Milton Keynes General NHS Trust (1999)

Aged 32 Mrs C was delivered of a stillborn child. Following delivery Mrs C developed signs of infection. The placenta gave off an odour and blood test demonstrated raised white cell count.

Mrs C was prescribed antibiotics at 5pm with instructions they should be started at 10 pm. In the event antibiotics were not started until much later.

Mrs C died. 

BREACH OF DUTY

It was argued that there was an unacceptable delay in identifying infection and commencing antibiotics

CAUSATION

t was argued that prompt antibiotic therapy would have resulted in survival

OUTCOME

Although liability was disputed compensation for the estate of Mrs C and her dependents was agreed at £150,000
