Who Can Claim Fatal Accident Compensation?

There is often confusion into who can claim compensation for fatal accidents. The law states that people who have close family ties, such as children, wife or husband or partner, or those who are financially dependant in some way are the people who can bring a claim.    

This includes:
  • Widow or Widower
Due to the loss of a loved one the surviving wife or husband of the deceased may find themselves in financial difficulties. Financial aid is available for widows and widowers providing that the death of the deceased was the result of third party or negligence.

  • Children of the Deceased
If a parent(s) dies as the result of a fatal accident, the remaining child or children will be entitled to claim compensation under the Fatal Accident Act 1976. This is either done as part of the surviving parent's claim or in a separate assessment for the child.

  • Parents of the Deceased
If an adult child dies in a fatal accident, and they have contributed to the maintenance of their parent(s), the parents can make a claims for compensation based on the deceased child's contribution. When claiming for an infant child in a fatal accident the parent(s) are entitled to claim compensation for bereavement. 

  • Cohabiting Partners of the Deceased

If a partner of the deceased has been co-habiting for two years or more then they are entitled to claim fatal accident compensation.
